What are the requirements to be a shipping agent?

Based on resolution No. 47-96, articles 3 and following, establish that:
Article 3.-In order to carry out the activities of shipping agent of vessels in local authorized ports, under the supervision, control, management and exploitation of the Dominican Port Authority, it is obligatory to meet the requirements and procedures listed below:
Submit a justified written request to the Executive Director of the Port Authority together with the following documents:
Itemized listing of the ports where it is desired to operate as ship’s consignment broker:
Applicants must be moral or legal persons, companies, with subscribed and paid capital of no less than RD$ 250,000.00 (two hundred fifty thousand Pesos 00/100) Dominican pesos.
Registered copy of constituent documents of the commercial society;
No felony Certificate issued by the Attorney General of the Republic, in favor of the legal representatives of the company;
National taxpayer registry (N.C.R.) of the legal person or commercial entity (company) applicant.
Payment of RD$ 2,000.00 (two thousand Pesos 00/100 gold), by certified check on behalf of the Dominican port authority, to cover administrative expenses required for processing and filing of the relevant application;
Payment of RD$ 3,500.00 (three thousand five hundred Pesos gold with 00/100), certified check on behalf of the Ministry of Finance (MOF), which must be deposited in the Accounting Department of said Ministry , before processing the request.

Article 4.– The Dominican Port Authority, after review and analyzing the documents submitted by the applicants and finding them correct and in compliance, shall submit to the Board of Directors the application for the operating permit of Consignment Brokers of ships in the local ports , under its administration, management, Control and exploitation. After the Board´s authorization the Finance Ministry will complete the process to expedite the requested permit.


What are the requirements to operate as a logistics center?

Requirement or condition:
Request addressed to the Director General of Customs requesting authorization to operate as a logistics center.
Copy of the property title or in its absence the lease contract or public conception duly legalized. Affidavit certifying that neither the legal applicant, nor its partners or shareholders, legal representatives, or members of the Board of Directors, have been judicially sanctioned during the 10 years preceding the application, for crimes or intentional violations of tax and customs laws; or have never been convicted of drug trafficking or money laundering issues.
Non felony certification issued by the Attorney General of the Dominican Republic, showing shareholders, members of the Board of Directors and legal representative of the company.
A certificate that accredits him as authorized economic operator. issued by the Internal Revenue Agency (DGII), declaring that are up to date in the payment of their tax obligations.
Copies of the plans or prospects, indicating offices, sites of customs control, scales, soil analysis, environmental studies, and the electrical wiring plans, duly approved by the Public Works Department.
Certification of the Environmental Agency certifying that it complies with environmental requirements.
Present a study of technical feasibility, complying with the specifications set forth in sections i, ii and iii of paragraph e of article 5 of the Decree No. 262-15.
Submit insurance policy against fire, theft, floods and natural disasters.
Presentation of the cost/benefit analysis carried out by the Finance Ministry.
Payment of 100,000 Pesos (RD$ 100,000.00), by certified check on behalf of the Customs Department archives in the headquarters of the Customs Department, to cover administrative expenses required for processing and filing of the corresponding application.
Procedures to be followed:
The Interested party shall deposit a duly bound record with the requirements laid down in correspondence and the Customs Department headquarters Central file.


What are the requirements to be logistics operator?

Requirement or conditions:
Request addressed to the Director General of Customs requesting authorization to operate as a logistics operator.
Evidence proving to be located within a logistics center or copy of the license to operate as a bonded warehouse, re-export warehouse or warehouse of consolidation and Deconsolidation, must have up to date bail.
Affidavit in which it is recognized that neither the legal person who applies, or its partners or shareholders, legal representatives, nor members of the Board of Directors, have been sanctioned during the 10 years preceding the application, for crimes or intentional violations of tax and customs laws; and who have never been convicted of drug trafficking or money laundering issues.
Certification of no felony issued by the Attorney General of the Republic, showing the shareholders of the company.
Have not been guilty of fiscal crime.
Certificate issued by the Directorate General of internal taxes (DGII), stating that they are up to date in the payment of their tax obligations.
Economic and technical feasibility study demonstrating the activity and logistics development that it will offer to third parties or to will implement for itself, must be submitted to the Ministry of Finance for the purposes of preparation of the cost-benefit analysis referred to in article 45, of law No. 253-12.
An Insurance policy, in favor of or endorsed to the General Customs Directorate (DGA), to respond for any unpaid duties and taxes of goods at its facility.
Fire and Allied lines insurance policy, covering the goods under deposit.
Payment of fifty thousand Pesos (RD$ 50,000.00), by certified check on behalf of the General Directorate of Customs, to cover administrative expenses required for processing and filing of the corresponding application.
Procedures to be followed:
Interested party will deposit a duly bound record containing the requirements already laid down in correspondence and the Direction General of Customs Headquarters Central file.


What are the requirements to apply for certification as authorized economic operator (AEO)?

Requirement or conditions:
Self-assessment questionnaire.
Application form, available in the module Follow-OAS.
The DGII RNC certification.
Mercantile registry.
List of majority shareholder, Board Member, legal representative, tax advisor…
Certification issued by the Director General of Internal Revenue (DGII), where it is stated that it is up to date in the payment of their tax obligations.
Copies of the three (3) recent audited financial statements and reports of the independent auditors.
License, authorization, registration or resolution that support the operations of the company issued by the competent authority.
Organizational chart of the company.
Map of processes.
An array of critical positions.
Updated matrix of risks.

Procedures to be followed:
Applicant company deposits in the Correspondence and File Department of the Customs Department Headquarters the application form for certification and other required documents.


What are the requirements for the provision of services to the Dominican Port Authority (APORDOM)?

As set out in the regulations for the provision of services 1673, the utilization by the users, whether individuals or companies; of the facilities or port facilities, or any of its services, constitutes prior acceptance of the current port rates.
